I had seen a news segment on it this week and I believe helping employers decide on the legality of a new-hire and punishing those who ignore the status is the best way to go. E-Verify looks good (with my limited research). Arizona has made it mandatory for all businesses and Georgia is considering. Illinois has made it illegal. Department of Homeland Security has published guidelines for employers to follow after the system flags a person. This will reduce lawsuits for incorrect information.
